These Terms of Use (“Terms”) govern your access to and use of Flowkar’s website, app, and related services (collectively, the “Services”). Flowkar is operated by Flowkar Technologies Pvt. Ltd. (“Flowkar”, “we”, “us”, or “our”).
By creating an account or using the Services, you agree to these Terms. Please read carefully. If you do not agree, you must not use Flowkar.
1. Nature of Services
Flowkar provides:
- Scheduling, account, and service management tools for professionals and businesses.
- Markent Platform – A specialized feature for skill-based promotional contests and influencer marketing campaigns.
Contests hosted on Flowkar are not gambling or betting.
- No participant fees are pooled into prize money.
- Rewards are brand-sponsored.
2. Eligibility
- You must be at least 18 years of age (or the legal age of majority in your country).
- A valid Flowkar account and, where required, KYC verification are mandatory.
- It is your responsibility to ensure that the use of Flowkar contests or campaigns is legal under
your local jurisdiction.
3. User Accounts
Registration
To access Services, you must register with an email and password (or via supported social networks such as LinkedIn and Vimeo).
Responsibility
You are responsible for all activity under your account and must safeguard login credentials.
Accuracy
Information provided must be accurate, complete, and updated.
Termination
Flowkar reserves the right to suspend or terminate accounts for violations of these Terms.
4. User Conduct
You agree not to:
- Use Flowkar for any illegal activity.
- Post or upload offensive, defamatory, obscene, or infringing content.
- Harass, impersonate, or misrepresent identity.
- Engage in spam, phishing, or malicious activities.
- Circumvent Flowkar’s payment, campaign, or security systems.
For contests:
- Submit fake receipts, counterfeit IDs, or fraudulent content.
- Use bots, purchased engagement, or manipulate results.
5. Content & Permissions
User Content
You retain ownership of content shared. By posting, you grant Flowkar a non-exclusive, worldwide, royalty-free license to use, display, and distribute content for service-related purposes.
Moderation
Flowkar may remove content that is unlawful, harmful, or violates these Terms.
Device Permissions
Flowkar may request access to:
- Storage (for saving/uploading files),
- Camera (for photo/video capture),
- Microphone (for voice inputs).
6. Brand Responsibilities (Markent Platform)
- Brands using Flowkar must deposit:
- Prize fund,
- Product reimbursement (if applicable), and
- Non-refundable 5% Flowkar platform fee.
- Brands must clearly define influencer selection criteria (e.g., followers, content themes,
deadlines).
- If influencer slots remain unfilled, proportional refunds may be issued (except platform fee).
7. Influencer Responsibilities
- Must meet eligibility and KYC verification requirements.
- Where required, influencers must purchase products and submit authentic receipts.
- Content must meet campaign guidelines and deadlines.
- Fake engagement, bots, and manipulated results are prohibited.
- A 10% fee (covering platform + processing) is deducted from winnings before payout.
8. Payments & Fees
- Brands: 5% non-refundable fee on deposits.
- Influencers: 10% deduction on payouts.
Payouts
Released through Flowkar Wallets, withdrawable via payment providers (Razorpay, Stripe, Payoneer, PayPal, banks).
Taxes (e.g., TDS in India, or applicable international withholdings) may be deducted.
9. Prize Distribution
Winners are determined based on:
- If all slots for the Markent are not filled and/or the Markent has not yet started, the displayed
positions and the secured prize amounts will not be considered valid.
- Verified API-based engagement metrics (likes, views, shares, etc.), and
- Brand’s approval of submitted content.
Flowkar generates a final leaderboard. The results are final and binding.
10. Refunds
Refunds are only available when:
- A competition is cancelled before launch, or
- Influencer slots are unfilled.
Note: Platform fees and already reimbursed product funds are non-refundable.
11. Termination
Flowkar may suspend or terminate your account at its sole discretion if you:
- Violate the Terms,
- Harm other users, brands, or Flowkar, or
- Engage in fraudulent/malicious activities.
12. Disputes & Liability
Flowkar operates as a facilitator and escrow manager; we are not liable for disputes between brands and influencers.
Flowkar may hold or reverse payouts in case of fraud or disputes.
Limitation of Liability
Flowkar is not liable for:
- Loss of profits, revenue, goodwill, data, or indirect damages.
- Service interruptions, cyberattacks, or third-party conduct.
13. Disclaimer of Warranties
Services are provided “as is” and “as available” without any warranties (express or implied). Flowkar does not guarantee uninterrupted service, error-free operation, or freedom from viruses.
14. Compliance & Legal Framework
Flowkar contests are skill-based promotional activities (not gambling/money games).
Compliance
- India → Promotion and Regulation of Online Gaming Bill, 2025; GST, IT, and DPDP Act requirements.
- International → Relevant e-sports, contest, and consumer protection laws.
15. Governing Law
For Indian Users → Governed by the laws of India.
16. General Provisions
- These Terms constitute the entire agreement.
- Rights may not be transferred without Flowkar’s written consent. Flowkar may assign rights to
affiliates or successors.
- If any clause of these Terms is invalid, the remaining clauses remain fully enforceable.
17. Changes to Terms
Flowkar reserves the right to amend these Terms at any time.
Updates will be posted on the app and website.
Continued use of Flowkar Services after changes means acceptance of the updated Terms.
